Construction Law and Litigation
- Negotiated $2,125,000 settlement on behalf of local municipality in construction defect claim against contractor, architect, stucco manufacturer and subcontractors related to water intrusion and structural deficiencies at its operations center.
- Settled more than $10,000,000 worth of condemnation matters on behalf of local municipalities.
- Obtained $400,000.00 judgment on behalf of homeowner against builder for breach of contract during construction of custom residential home.
- Represented a commercial framing contractor that was named as a defendant in a construction defect lawsuit arising out of the construction of a Myrtle Beach condominium project. The framer should have been covered under its subcontractors’ insurance policies as an additional insured, but when one carrier failed to defend the framer—its additional insured—the framer sued for bad faith. The ruling in favor of the commercial framing contractor recognized that an additional insured under an insurance policy has standing to bring a bad faith claim against the carrier if it is not meeting its obligations under the policy, even though they are not a named insured.
- Defended and resolved a personal injury mold case filed against a general contractor.
- Obtained summary judgment on behalf of a surety in a construction defect lawsuit based on the application of South Carolina’s statute of repose.
- Represented general contractor in the settlement of a construction defect on a multi-family, 84-unit condominium project.
- Negotiated $600,000.00 settlement on behalf of homeowner in construction defect and breach of contract claim against design professional and homebuilder.
- Obtained $457,540.00 judgment on behalf of an Architect against homeowner in mechanic’s lien case where Architect did not receive payment for work performed during the design and construction phase of a plantation home. The ruling, which was upheld by the South Carolina Court of Appeals, acknowledged that construction administrative services performed by an Architect are considered labor and lienable under the mechanic’s lien statute.
- Recovered more than $1,015,000 in the context of a FINRA arbitration for a family when their investment broker’s negligence and deceitful advice caused them substantial investment fund losses.
- Serves as general counsel to multiple general contractors, developers and subcontractors.
- Negotiated residential home buyback on behalf of two separate homeowners against two different large residential homebuilders as a result of construction deficiencies in the original construction of the home.
- Received summary judgment on behalf of general contractor against subcontractor for contribution resulting from subcontractor’s failure to participate at mediation in good faith.
- Participated in the successful prosecution and appeal of a mechanic’s lien case acknowledging that construction administrative services performed by an Architect are considered labor and lienable under the South Carolina mechanic’s lien statute.
Business and Commercial Litigation
- Recovered more than $1,015,000 in the context of a FINRA arbitration for a family when their investment broker’s negligence and deceitful advice caused them substantial investment fund losses.
- Represented a real estate developer in settling a breach of contract lawsuit against its joint venture partner based on claim that partner tried to secretly sell the partnership property and assets to a third party, while wrongfully excluding our client.
- Represented state agency in defending against a nonprofit organization’s lawsuit that sought to prevent the agency from turning an aged submarine into a coastal reef.
- Represented a provider of restaurant equipment and supplies in a breach of contract action against a supplier that failed to deliver a shipment of product as promised under the contract.
- Represented limited liability company in negotiating and drafting a buyout agreement with the estate of the company’s deceased member.
- Successfully negotiated the resolution of a claim involving a commercial fishing vessel destroyed by fire against a third-party insurer.
Probate, Estate, and Trust Litigation
- Represented clients in probate litigation involving who was entitled to receive the decedent’s collection of valuable German artwork, sculptures, and other tangible personal property which had belonged to the decedent’s family from the early to mid-1900s. The Probate Court ruled that our clients were to receive the personal property by virtue of an informal “separate writing” which he had created on his computer shortly before his death and which he referenced in his will.
- Represented personal representative of an estate in recovering the proceeds of a bank account jointly held by the decedent which the other account holder had withdrawn without authorization shortly before the decedent’s death.
- Represented the decedent’s intestate heirs in a legal challenge to a last will and testament allegedly executed by the decedent shortly before her death.
- Represented trust beneficiaries in a trustee removal action against the trustee of the trust under South Carolina’s version of the Uniform Probate Code’s “no fault” trustee removal provision.
- Represented a trustee in an action filed by a disappointed trust beneficiary who sought to defeat the settlor’s amendments to the trust.
- Represented a personal representative and beneficiary of an estate in defending against an action seeking to invalidate the decedent’s last will and testament.
Administrative and Government Law
- Participation in the creation of ordinances, resolutions, bylaws, and operational policies for numerous local governmental entities.
- Successfully represented local government entity in resolving a land condemnation dispute which allowed the government entity to keep the land as-is.
- Achieved numerous just compensation verdicts at trial and defended the ruling of an eminent domain case in the South Carolina Court of Appeals involving the interpretation of the South Carolina Eminent Domain Procedures Act.
- Attained summary judgment on behalf of a governmental entity in Federal District Court against a real estate developer that brought constitutional claims related to the extension of sewer service to a property.
- Obtained dismissal of a Complaint filed by a real estate developer challenging water and wastewater policies, resolutions, and ordinances of a local governmental entity.
- Successfully defended a local government entity in an eminent domain challenge action filed by a real estate developer.
- Prosecuted and defended numerous condemnation cases involving utility easements and fee simple acquisitions on behalf of landowners and local governmental entities.
Employment and Labor Law
- Represented a group of former and current employees of South Carolina based ArborGen, Inc. in a breach of fiduciary duty case where clients were awarded damages of $53,508,288. This verdict was included as one of the Top Verdicts in South Carolina in 2015 and one of the Top 50 Verdicts in the U.S. in 2015. Foutz, et al. v. Arborgen, Inc., et al., 2015 WL 10435042 (S.C.Com.Pl.)(Trial Order). Claim was later settled for a confidential undisclosed amount.
- Represented an executive level employee in a breach of contract action against his former employer. The primary issue involved whether the employer had complied with the former executive’s severance compensation package.
- Represented an executive level employee in negotiating and drafting a severance agreement and compensation package following her separation from employment with the company.
